The Contractor will start the Work no later than ___ and finish it by _____, hereinafter referred to as 'Time for Completion'. The Work will be finished when the Contractor has properly done everything shown in the description of the work and any changes to them.
(ค) ผู้รับจ้างตกลงจะเริ่มการงานไม่ช้ากว่า ______ และจำทำการงานให้เสร็จสิ้นภายใน______ ต่อไปในสัญญานี้เรียกว่า “เวลาแล้วเสร็จของการงาน” โดยการงานจะถือว่าแล้วเสร็จต่อเมื่อผู้รับจ้างได้ปฏิบัติการงานเรียบร้อยครบถ้วนทุกประการตามที่กำหนดไว้ในสัญญานี้หรือตามที่จะได้มีการตกลงแก้ไขเป ลี่ยนแปลงกัน
This contract is between the customer and contractor only. A third party consultant or architect has not been appointed.
สัญญาฉบับนี้ทำขึ้นระหว่างผู้ว่าจ้างกับผู้รับจ้างเท่านั้น และไม่ถือว่าสัญญาฉบับนี้ได้มีการแต่งตั้งที่ปรึกษาหรือสถาปนิกซึ่งเป็นบุคคลภายนอกแต่อย่างใด
NOW IT IS HEREBY AGREED as follows: ดังนั้นคู่สัญญาจึงได้ตกลงกัน โดยมีข้อความ ดังต่อไปนี้
1. PLANNING PERMISSION AND BUILDING REGULATIONS แบบขออนุญาตก่อสร้างและใบอนุญาตก่อสร้างอาคาร
The Contractor will apply for any planning permission and building regulations approval or awards that may be needed. The contractor will not start work at the Site before any planning permission or awards that are needed have been received. However, the Contractor can start work before building regulations approval is received but he must to let the local authority know at least 48 hours before he starts.
หากกรณีจำเป็น ผู้รับจ้างจะต้องยื่นแบบขออนุญาตก่อสร้างและขอรับใบอนุญาตก่อสร้างอาคาร ผู้รับจ้างตกลงจะไม่เริ่มการงานในสถานที่ก่อสร้างก่อนที่จะได้รับอนุมัติแบบขออนุญาตก่อสร้างและได้รับใบอนุญาตก่อสร้างอาคารเป็นที่เรียบร้อยแล้ว แต่อย ่างไรก็ตาม ผู้รับจ้างอาจเริ่มการงานก่อนได้รับใบอนุญาตก่อสร้างอาคารแต่จะต้องแจ้งให้เจ้าพนักงานท้องถิ่นทราบอย่างน้อย 48 ชั่วโมงก่อนเริ่มการงาน
2. PRICE ราคาค่าจ้าง
2.1 The price for the Work is Baht __________ (including any VAT), hereinafter referred to as 'the Price'

2.2. In the Price is included the Contractor's costs for applying for planning permission and building regulations approval or awards.
2.2 ราคาค่าจ้างนั้นรวมค่าใช้จ่ายของผู้รับจ้างในการจัดเตรียมและยื่นแบบขออนุญาตก่อสร้างและขอรับใบอนุญาตก่อสร้างอาคารแล้ว
2.3 All materials, equipment and accessories requires in the Work shall be procured by the Contractor in accordance with the quantity and quality described in the plans specifications attached to this agreement.
2.3 ผู้รับจ้างจะต้องจัดหาบรรดาสัมภาระ อุปกรณ์และเครื่องมือเครื่องใช้ทั้งหมดที่ต้องใช้ในการงาน ทั้งนี้ตามคุณภาพและปริมาณตามที่กำหนดไว้ใน แบบและรายการก่อสร้าง เอกสารแนบท้ายสัญญานี้
2.4 The Price also includes the contractor's costs of dealing with any unexpected problems which he could have discovered by carrying out a careful inspection before the price was agreed.
2.4 ราคาค่าจ้างให้รวมค่าใช้จ่ายของผู้รับจ้างสำหรับการติดต่อประสานเกี่ยวกับปัญหาต่างๆที่อาจเกิดขึ้นซึ่งผู้รับจ้างสามารถรู้ได้โดยหากได้พิจารณาตรวจสอบ โดยถี่ถ้วนก่ อนคู่สัญญาจะ ได้มีการตกลงราคาค่าจ้างกัน

10. MISCELLANEOUS ข้อกำหนดอื่นๆ
10.1 The Contractor will give the customer any guarantees issued by the manufacturers of products installed in the work.
10.1 ผู้รับจ้างจะต้องส่งมอบบรรดาใบรับประกันสินค้าซึ่งได้ทำการติดตั้งในการทำการงานให้แก่ผู้ว่าจ้างซึ่งออกให้โดยผู้ผลิต
10.2 The Contractor shall obtain on behalf of the Customer a house registration book (Tar.Bian.Baan) and apply for utilities such as government water, electricity and electricity meter.
10.2 ผู้รับจ้างจะต้องติดต่อขอออกเลขหมายประจำบ้านในนามของผู้ว่าจ้างให้แก่ผู้ว่าจ้างและจะต้องดำเนินการขอติดตั้งสาธารณูปโภคต่างๆ ต่อหน่วยงานที่มีอำนาจหน้าที่ เช่น การประปา การไฟฟ้า และการติดตั้งมิเตอร์ไฟฟ้า
10.3 All cables, telephone lines, gutters, water piping and such shall be underground.
10.3 บรรดาเคเบิล สายโทรศัพท์ ท่อ ท่อน้ำต่างๆจะต้องดำเนินการติดตั้งแบบใต้ดิน
10.4 The contractor will have an all risks insurance policy to cover himself and the customer for the full costs of damage to the work.
10.4 ผู้รับจ้างจะต้องประกันภัยความเสี่ยงเพื่อตนเองและเพื่อผู้ว่าจ้างสำหรับความเสียหายทั้งหมดที่อาจเกิดขึ้นแก่การงานที่ทำนั้น
10.5 The Customer is allowed to appoint an agent to inspect the Work and carry out any test of any materials or goods whether or not already incorporated in the Work.
10.5 ผู้ว่าจ้างอาจแต่งตั้งตัวแทนเพื่อทำการตรวจสอบการงานและทำการทดสอบวัสดุหรือสิ่งของใดๆไม่ว่าสิ่งเหล่านั้นจะได้นำมาใช้ในการงานแล้วหรือไม่ก็ตาม
10.6 Any notice between the Contractor and Customer shall be given in writing and delivered at the addresses stated above.
10.6 บรรดาหนังสือบอกกล่าวระหว่างผู้รับจ้างและผู้ว่าจ้างให้ทำเป็นหนังสือและส่งไปยังที่อยู่ตามที่ปรากฎในสัญญานี้
11. GOVERNING LAW กฎหมายที่ใช้บังคับ
This Agreement shall be governed and construed in accordance with the laws of Thailand. If any dispute or difference arises under this Agreement either party may refer it to adjudication or arbitration under the rules of the Thai Arbitration Institute as well as the right to go to Court.
สัญญาฉบับนี้ให้บังคับและตีความตามกฎหมายแห่งราชอาณาจักรไทย หากมีข้อพิพาทใดๆเกิดขึ้นตามสัญญาฉบับนี้ ก่อนที่จะนำเรื่องขึ้นสู่การพิจารณาพิพากษาของศาลไทย คู่สัญญาทั้งสองฝ่ายจะต้องนำเรื่องเข้าสู่การพิจารณาวินิยฉัยของอนุญาโตตุลาการ ตามระเบียบอนุญาโตตุลการของประเทศไทย
This agreement is made in two duplicates. The parties to this agreement having read and understood the entire the entire substance contained herein sign their names in the presence of witnesses on the day, month and year first written above.
